Jailbreaking a “legal violation” is the issue since the technology is becoming the fashion. The US government acclaimed the act of jailbreaking as legal two years back which can be expire this year if it isn’t renewed. EFF “Electronic Frontier Foundation” is the leading element in the jailbreaking as legal act.

“The Digital Millennium Copyright Act renwes with an exemptions proces in which the Library of Congress every three years makes exemptions to the particular law which have to be renewed undergo the next cycle. In the previous cycle, the Electronic Frontier Foundation asked for an exemption for jailbreak a smartphone which someone owns, so that to run own software would’nt be a violation of the Digital Millennium Copyright Act, section 1201. Its a tricky area in the terms of interpreting the Digital Millennium Copyright Act! The terms are not clear at all. One thing is clear that device manufacturers have used the DMCA specifically to enforce incompatibility with third-party products. The point is, oftenly courts allowed that and mostly they haven’t. So, this is the case to shut out competition.
The important question raised is what kind of rights, do the hardware manufacturers have over the hardware once it’s been sold to buyer?
Purchasers can have rights which come from contracts. For instance someone gets a smartphone and carrier is told about what he can and can’t do with the smartphone. It’s easy to follow the simple rules but when you go to the rights which are good or bad the issue at hand it is exactly that. It becomes the matter of rights of a hardware manufacturer and the owner of a piece of hardware, which is a class of negative rights. Sometimes things are not stated in the law clearly, but even then such isssues are understood. The Copyright Office posts and comments on jailbreaking says that to prevent jailbreaking is just like welding the hood shut on a car which legally prevent from modifying a car but looks absurd to many people.
Anyone of you, who’s in favor of jailbreaking smartphones and tablets then go with the EFF is also fighting for jailbreaking game consoles, give your reason why the act of jailbreaking should remain legal.
